Welcome to Obsidian Standard. These Terms of Service govern your access to and use of our website, products, services, content, and purchases made through our store. By visiting our website, placing an order, or purchasing from Obsidian Standard, you agree to be bound by these Terms.

Please read these Terms carefully before using our site or purchasing any product. If you do not agree with these Terms, you should not use our website or place an order.

1. Overview

Obsidian Standard offers curated artwork, prints, framed artwork, and related products. Our collection may include works created through a variety of artistic methods, including photography, digital editing, compositing, illustration, AI-assisted tools, generative AI processes, and other creative techniques.

By purchasing from Obsidian Standard, you acknowledge that each product is made or fulfilled according to the product details available at the time of purchase and that all orders are subject to these Terms.

2. Eligibility

By using this website or placing an order, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have permission from a parent or legal guardian to use this site.

You agree not to use our website or products for any unlawful purpose or in violation of these Terms.

3. Creative Process, Artistic Mediums, and AI-Assisted Works

Obsidian Standard features artwork created through a range of artistic methods and creative processes. Depending on the artist and the piece, works may involve photography, digital editing, compositing, illustration, AI-assisted tools, generative AI, or a combination of human-directed and technology-assisted methods.

By using this site and purchasing from Obsidian Standard, you acknowledge and accept that each artist may use their own chosen medium, process, and creative workflow, and that some artworks may be partially AI-assisted or fully AI-generated.

Unless expressly stated otherwise, product descriptions should not be interpreted as a guarantee that a work was created exclusively through traditional photography, painting, illustration, or any other single medium. We curate artwork based on visual quality, creative direction, and final presentation, regardless of the tools or methods involved in the creation process.

4. Product Descriptions and Artwork Representation

We make reasonable efforts to display and describe our products as accurately as possible. However, we cannot guarantee that your device’s screen will accurately display the true color, tone, contrast, texture, scale, or detail of any artwork.

Product images, mockups, room previews, frame examples, and lifestyle images are provided for illustrative purposes only. Actual print size, cropping, framing proportions, color, finish, and appearance may vary slightly depending on the selected product, production process, and display settings.

Minor differences between the product image shown online and the final delivered artwork do not constitute a defect.

5. Printing, Framing, and Fulfillment

Our artworks may be printed, framed, and fulfilled through trusted production partners. We work to ensure that each order is produced with care and presented according to the options selected at checkout.

Because artwork production can involve physical materials, production processes, and fulfillment partners, slight variations may occur between orders. These variations are normal and do not affect the overall quality or intended presentation of the artwork.

6. Made-to-Order Products

Many of our products are made to order. This means the artwork may be produced specifically for each customer based on the selected artwork, size, frame, and other available options.

Because of this, orders may enter production shortly after purchase and may not be eligible for cancellation once production has started.

By placing an order, you acknowledge that the product is custom-produced or fulfilled based on your selections at checkout.

7. Order Acceptance and Cancellation

After placing an order, you may receive an order confirmation email. This confirmation does not guarantee final acceptance of your order.

We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, pricing errors, product availability issues, incorrect customer information, fulfillment limitations, or violations of these Terms.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

Once an order has entered production, we may not be able to cancel or modify it.

8. Pricing and Payment

All prices are listed in the currency shown at checkout. Prices are subject to change without notice.

We reserve the right to correct pricing errors, product description errors, discount errors, or availability errors at any time. If an error affects an order you placed, we may contact you to revise, cancel, or refund the order.

You agree to provide current, complete, and accurate billing, shipping, and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.

9. Shipping and Delivery

Shipping times are estimates only and are not guaranteed. Because many of our products are made to order, total delivery time may include both production time and transit time.

We are not responsible for delays caused by carriers, customs, weather, incorrect shipping information, failed delivery attempts, local disruptions, or events outside of our control.

Customers are responsible for providing accurate shipping information. If an order is delayed, lost, returned, or delivered incorrectly due to inaccurate shipping details provided by the customer, Obsidian Standard is not responsible for replacing or refunding the order.

Risk of loss passes to you once the order is delivered to the shipping address provided at checkout.

10. International Orders, Customs, Duties, and Taxes

For international orders, customers may be responsible for customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country. These fees are not included unless expressly stated at checkout.

Obsidian Standard is not responsible for delays caused by customs processing or for any additional fees required by local authorities.

11. Returns, Refunds, and Exchanges

Because many of our artworks are made to order, we do not generally accept returns, refunds, or exchanges for reasons including buyer’s remorse, incorrect size selection, color expectations, change of mind, or failure to review product details before purchase.

However, if your order arrives damaged, defective, or incorrect, please contact us within [X days] of delivery with your order number and clear photos of the product, packaging, shipping label, and issue.

If we determine that the product arrived damaged, defective, or incorrect due to production or fulfillment error, we may offer a replacement, repair, store credit, or refund at our discretion.

We reserve the right to deny claims that are incomplete, submitted late, unsupported by photos, or caused by customer handling, improper installation, normal wear, or damage after delivery.

12. Damaged or Incorrect Orders

If your order arrives damaged or you receive the wrong item, you must notify us promptly. Please keep all original packaging, as photos of the packaging may be required to process a claim.

Do not discard the product or packaging until we have reviewed your claim. Failure to provide required evidence may prevent us from offering a replacement or refund.

13. Intellectual Property

All artwork, images, photographs, designs, graphics, text, logos, branding, product names, website content, and related materials displayed on this website are owned by Obsidian Standard, our artists, licensors, partners, or other rights holders.

Purchasing a print or product does not transfer copyright, reproduction rights, commercial rights, or intellectual property ownership to you. Your purchase grants you ownership of the physical product only.

You may not copy, reproduce, distribute, modify, scan, photograph for reproduction, resell, license, mint as an NFT, use commercially, or create derivative works from any artwork or content without prior written permission from the rights holder.

14. Personal Use Only

Unless expressly agreed in writing, all products purchased from Obsidian Standard are for personal, non-commercial display use only.

You may not use our artwork or products for commercial advertising, resale, branding, promotional materials, editorial use, public exhibitions, or other commercial purposes without written permission.

15. Artist Rights and Third-Party Rights

Some artworks may be created, licensed, or contributed by independent artists, collaborators, or third-party creators. These artists and rights holders retain their respective rights in their works unless otherwise agreed.

We make reasonable efforts to ensure that works offered through Obsidian Standard are properly authorized for sale. If you believe any content on our website infringes your intellectual property rights, you may contact us so we can review the matter.

16. User Submissions and Communications

If you submit reviews, photos, feedback, comments, emails, messages, or other content to us, you grant Obsidian Standard a non-exclusive, royalty-free, worldwide right to use, reproduce, publish, display, and share that content for business, marketing, customer service, and promotional purposes, unless otherwise prohibited by law.

You agree that your submissions will not be unlawful, abusive, defamatory, obscene, infringing, misleading, or harmful.

17. Prohibited Uses

You agree not to use our website, products, or content:

For any unlawful purpose;
To violate any intellectual property rights;
To harass, abuse, defame, threaten, or discriminate against others;

20. Accuracy, Availability, and Website Changes

We reserve the right to update, modify, suspend, or discontinue any part of our website, products, pricing, descriptions, policies, or services at any time without notice.

We do not guarantee that the website will always be available, secure, uninterrupted, or error-free.

21. Disclaimer of Warranties

To the fullest extent permitted by law, Obsidian Standard, its owners, employees, contractors, artists, suppliers, fulfillment partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the website, purchase of products, or inability to use our services.

Our total liability for any claim related to an order shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

23. Indemnification

You agree to indemnify, defend, and hold harmless Obsidian Standard, its owners, employees, contractors, artists, suppliers, fulfillment partners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your violation of these Terms, misuse of the website, infringement of intellectual property rights, or unlawful conduct.
